The Presumption of Joint Parenting in Family Law: Legal Framework and Implementation

Abstract. The article highlights the shortcomings of the current broad-discretion approach to determining child's place of residence after divorce. The aim is to substantiate a rebuttable presumption of joint parenting. Through comparative and formal-legal analysis, the author establishes the basis for rebuttal and proposes a procedural framework. The findings include recommendations to amend Articles 24, 65–66 of the Family Code of the Russian Federation and Article 79 of the Civil Procedure Code of the Russian Federation.
