Objective limitation period: problems of application

Abstract. The article is devoted to the new limitation period introduced in 2013, called objective in the legal literature. Their main difference from the general, so-called subjective limitation period is noted, which boils down to the difference in the calculation of their beginning. Separately, it is mentioned about the limitation period for obligations with an indefinite period of performance and the specifics of the beginning of its course - from the moment of the appearance of the right of claim. The author indicates the purpose and sources of the appearance of objective limitation periods in Russian legislation. Considering two models of the course of subjective and objective limitation periods, the author comes to the conclusion that the existence of an objective limitation period is advisable only if the course of the subjective limitation period does not go beyond the objective.
